2. Acceptance of these terms

By accessing or using the PML Platform or other Palmer-Hunter digital services, you agree to comply with these Terms of Service. If you use the services on behalf of an organisation, you confirm that you are authorised to act for that organisation in relation to your use of the services.

3. Accounts and authorised users

Some Palmer-Hunter services require an account. Users must provide accurate information, keep account credentials secure and use the services only within the permissions granted to them.

Organisations are responsible for managing their authorised users, roles and access rights and for promptly removing or updating access where a user's role or authority changes.

4. Permitted use

You may use Palmer-Hunter services only for lawful purposes and in accordance with your organisation's authorised deployment, subscription, licence, project or research arrangement.

You must not:

• attempt to gain unauthorised access to accounts, systems, devices, data or infrastructure;
• interfere with, disrupt or deliberately impair Palmer-Hunter services, devices or communications;
• use the services to transmit malicious code or conduct unlawful, fraudulent or abusive activity;
• bypass security, entitlement, access-control or technical restrictions;
• reverse engineer, decompile or attempt to derive proprietary source code, algorithms or models except where such restriction is prohibited by law; or
• use Palmer-Hunter technology in a way that infringes the rights of another person or organisation.

5. Organisation administrators

Where an organisation appoints administrators or other privileged users, those users may be able to manage accounts, devices, deployments, permissions, subscriptions or organisational data. The organisation is responsible for ensuring that such access is appropriately authorised and managed.

6. Devices, firmware and connectivity

Palmer-Hunter services may interact with sensing devices, embedded firmware, local applications, Bluetooth, network connections, cloud services or other communications systems.

Device and service performance may depend on factors outside Palmer-Hunter's direct control, including connectivity, power, installation conditions, environmental conditions, third- party infrastructure and customer-operated equipment.

Palmer-Hunter may provide firmware, configuration, maintenance, security or service updates where reasonably required to operate, secure or improve supported devices and services.

7. Environmental data and telemetry

Palmer-Hunter systems may collect, transmit, store and analyse environmental measurements, device telemetry, operational events and deployment information as part of the services.

Customers and users remain responsible for ensuring that they are authorised to collect and submit information from their sites, projects, participants or environments where such authority is required.

8. Environmental Intelligence outputs

Palmer-Hunter services may transform measurements and telemetry into patterns, classifications, estimates, interpretations, predictions, alerts, analytics or other Environmental Intelligence outputs.

These outputs are intended to support monitoring, analysis and decision-making. They do not constitute an unconditional guarantee of environmental conditions, future events or outcomes. Sensor behaviour, environmental variability, deployment conditions, data quality, model limitations and other factors can affect the accuracy or completeness of an output.

Users should consider Environmental Intelligence outputs together with the context of the relevant deployment and any professional, regulatory, scientific, operational or safety requirements applicable to the decision being made.

9. Customer and user information

Customers and users retain their rights in information they lawfully submit to Palmer-Hunter, subject to any rights granted under the applicable contract or service arrangement that are necessary for Palmer-Hunter to provide, secure, support and operate the services.

Personal information is handled in accordance with the Palmer-Hunter Privacy Policy.

10. Palmer-Hunter intellectual property

Unless expressly agreed otherwise in writing, Palmer-Hunter and its licensors retain all rights, title and interest in the technology underlying the services, including software, firmware, user interfaces, system architecture, algorithms, models, methodologies, model structures, Environmental Intelligence processes, documentation, trademarks, designs and other proprietary technology and materials.

Access to a Palmer-Hunter service does not transfer ownership of Palmer-Hunter intellectual property to a customer or user. Customers receive only the rights of access and use granted by the applicable service, licence, subscription, quotation or other written agreement.

11. Service availability and changes

Palmer-Hunter aims to provide reliable services but does not guarantee uninterrupted or error-free availability. Maintenance, security work, updates, infrastructure failures, connectivity issues and other operational circumstances may temporarily affect availability.

Palmer-Hunter may modify or improve service features where reasonably necessary for security, performance, regulatory compliance, product development or operational reasons.

12. Security responsibilities

Palmer-Hunter uses technical and organisational measures intended to protect its systems and services. Users must also take reasonable steps to protect their accounts, credentials, authorised devices and access methods.

Suspected unauthorised access, account compromise or security incidents affecting Palmer-Hunter services should be reported to Palmer-Hunter promptly.

13. Third-party services

Some Palmer-Hunter services may rely on or interoperate with third-party hosting, communications, payment, infrastructure or other services. Those providers may operate under their own terms, availability commitments and privacy practices.

14. Suspension and termination

Palmer-Hunter may suspend or restrict access where reasonably necessary to protect security, prevent misuse, investigate suspected unlawful activity, comply with legal obligations, address material breach of these terms or enforce valid entitlement or contractual restrictions.

Suspension or termination of a service does not automatically cancel outstanding contractual, payment, confidentiality, intellectual-property or other obligations that are intended to continue after access ends.

15. Service limitations

Palmer-Hunter provides technology for sensing, monitoring, analysis and Environmental Intelligence. Unless expressly agreed otherwise in writing, the services are not a substitute for professional advice, statutory inspection, regulatory certification or independently required safety systems.

Nothing in these Terms of Service excludes or limits liability where doing so would be unlawful. Any additional or specific limitations of liability applicable to a commercial customer relationship may be set out in the relevant Palmer-Hunter Terms & Conditions, quotation or written agreement.

16. Changes to these terms

Palmer-Hunter may update these Terms of Service where reasonably necessary to reflect changes to services, technology, security, law, regulation or business operations. The current version will be published on this website with its latest revision date.

17. Governing law

These Terms of Service are governed by the laws of England and Wales. Unless another jurisdiction is required by applicable law or agreed in writing, the courts of England and Wales will have jurisdiction in relation to disputes arising from these Terms of Service.
